1. Purpose and Scope

This Refunds & Returns Framework (the “Framework”) establishes the baseline requirements and procedures for returns, refunds, and exchanges for transactions conducted on the YuZaar Marketplace (the “Platform”). This Framework is designed to foster a trust-focused shopping experience while protecting the margins and operational integrity of our independent sellers.

By using the Platform as a Buyer or Seller, you agree to adhere to this Framework in conjunction with the YuZaar Marketplace Terms of Service and the Seller Onboarding Agreement.

2. Marketplace Role and Seller of Record

YuZaar Marketplace is a venue for independent brands and sellers. Unless explicitly stated otherwise in a specific product listing, YuZaar LLC is not the seller of record. The contract for sale is directly between the Buyer and the Seller. Consequently:

  • Seller Responsibility: The Seller is responsible for managing fulfillment, customer service, and return processing in accordance with this Framework.
  • Platform Facilitation: YuZaar provides tools to facilitate communication and payments but does not take title to any returned goods.

3. Seller Policy Requirements

Every Seller on YuZaar Marketplace must maintain a clear and conspicuous return policy on their storefront or within their product listings. At a minimum, Seller policies must:

  • Identify the return window (which must meet or exceed the Platform Minimums in Section 4).
  • Specify who bears the cost of return shipping for “Buyer’s Remorse” vs. “Seller Fault.”
  • Disclose any applicable restocking fees (not to exceed 20%).
  • Clearly list any “Final Sale” or non-returnable categories.

4. Platform Minimum Standards

To ensure a consistent customer experience, all Sellers must adhere to the following minimum standards:

  • Minimum Return Window: Sellers must allow Buyers to initiate a return request for at least 14 calendar days from the date of confirmed delivery.
  • Condition of Items: For standard returns (remorse), items must be returned in their original, unused condition, with all original packaging, tags, and accessories included.
  • Return Merchandise Authorization (RMA): Buyers must obtain an RMA through the Platform’s messaging system or “Request Return” tool before shipping any items back to the Seller.

5. Categorical Exceptions (Non-Returnable Items)

The following items are generally ineligible for return unless they arrive damaged, defective, or are significantly not as described:

  • Custom/Personalized Goods: Items manufactured to specific buyer specifications or engraved/personalized.
  • Perishable Goods: Food, flowers, or other items with a limited shelf life.
  • Hygiene/Personal Care: Items that cannot be resold for health or safety reasons once the seal is broken (e.g., cosmetics, earrings, undergarments).
  • Digital Products: Downloadable software, licenses, or virtual gift cards once delivered/accessed.
  • Hazardous Materials: Items containing flammable liquids or gases that pose safety risks during return transit.

6. Defective, Damaged, or “Not As Described” Items

If an item arrives damaged, is “Dead on Arrival” (DOA), or is materially different from the listing description (Significantly Not As Described or “SNAD”):

  • Reporting: The Buyer must report the issue within 7 days of delivery.
  • Seller Obligation: The Seller is responsible for providing a full refund or a replacement (at the Buyer’s discretion) and must provide a prepaid return shipping label.
  • Evidence: Buyers may be required to submit photographic or video evidence of the defect or damage to the Platform’s dispute center.

7. Return Shipping and Risk of Loss

  • Platform Policy (No YuZaar-Paid Returns): YuZaar LLC does not pay for return shipping under any circumstances.
  • Buyer’s Remorse: For returns involving “changed mind” or “incorrect size/fit” (where the listing was accurate), the Buyer is responsible for return shipping costs unless the Seller’s individual return policy states otherwise.
  • Seller Fault: For returns due to Seller error, damage/defect/SNAD, or other Seller fault, the Seller is responsible for return shipping costs (including any return label costs), consistent with the Seller’s individual policy and this Framework.
  • Risk of Loss: The risk of loss for returned items remains with the Buyer until the item is scanned as “delivered” at the Seller’s designated return address. We strongly recommend using tracked and insured shipping for high-value returns.

8. Refund Processing and Timelines

  • Inspection Period: Sellers have 5 business days from the receipt of the returned item to inspect the goods and confirm they meet the return criteria.
  • Issuance: Once approved, the refund will be issued to the original payment method.
  • Processing Time: Funds typically appear in the Buyer’s account within 5 to 10 business days, depending on the financial institution.
  • Original Shipping Fees: Original outbound shipping fees are non-refundable for “remorse” returns but are fully refundable for “Seller Fault” returns.

9. Abuse and Fraud Protection

YuZaar Marketplace actively monitors for “Friendly Fraud” and return abuse. We reserve the right to restrict or terminate the accounts of:

  • Buyers who demonstrate a pattern of excessive returns, “wardrobing” (buying items to use once and return), or returning empty boxes/different items.
  • Sellers who fail to honor their stated policies, provide sub-standard products, or intentionally delay the refund process.

10. Platform Intervention (Dispute Resolution)

If a Buyer and Seller cannot reach an agreement regarding a return or refund, either party may escalate the matter to YuZaar Marketplace Support.

  • YuZaar will review the transaction history, communication logs, and evidence provided.
  • YuZaar’s decision in these matters is final regarding the disbursement of funds held within the Platform’s payment ecosystem.
  • YuZaar does not provide legal representation for either party.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YUZAAR LLC DISCLAIMS ALL LIABILITY FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM THE RETURN OR REFUND PROCESS. OUR TOTAL AGGREGATE LIABILITY IN ANY DISPUTE IS LIMITED TO THE TOTAL FEES COLLECTED BY YUZAAR FROM THE SPECIFIC TRANSACTION IN QUESTION.
